Probate is the process of settling an estate. It is required when the deceased has left assets in his or her name only. A testate estate is one in which the decedent left a Last Will and Testament to direct the distribution of assets. The Will must be deposited with the Court within ten days of the death of the decedent. There is no filing fee for sending the will to the Court for safekeeping. An intestate estate is one in which the decedent did not leave a will to direct the distribution of the assets. In that case the probate laws of the state of Florida will take effect. For more information about Florida Probate law you can research Chapters 731 through 735 of the Florida Statutes.
If you wish to find out if a probate is ongoing or to find information about an active case, you may go to the second floor office at the Kim C. Hammond Justice Center to use the public computer system to conduct a search or you can send a written request to the court, which must include the decedent's name and date of death. It is also required that you send along a fee of $1.50 per year of search and a stamped, self addressed for the return of the information to you.
